These Terms and Conditions govern your use of the Quetta CafeFood delivery app product food delivery services, developed and maintained by Ninjabuilt TechnologiesSoftware house maintaining this platform through our website and mobile applications. By accessing or using our platform, you agree to be bound by these terms.

1. Introduction

Welcome to Quetta Cafe. These Terms and Conditions constitute a legally binding agreement between you (the “User”) and Ninjabuilt Technologies, the company that developed and maintains the Quetta Cafe food delivery platform. Our platform connects users with local restaurants and independent delivery riders to facilitate food ordering and delivery services.

By creating an account, placing an order, or using any feature of our service, you acknowledge that you have read, understood, and agree to comply with these terms. If you do not agree with any part of these terms, you must discontinue use of our platform immediately.

2. Definitions

“Platform” refers to the Quetta Cafe food delivery website, mobile application, and all related services developed and operated by Ninjabuilt Technologies.

“User” refers to any individual who accesses or uses the platform, including customers, restaurant partners, and riders.

“Customer” refers to a user who places food orders through the platform.

“Restaurant Partner” refers to food establishments that list their menu and accept orders through our platform.

“Rider” refers to independent delivery personnel who fulfill delivery requests through our platform.

“Order” refers to a request placed by a customer for food items from a restaurant partner.

“Service Fee” refers to the charges applied by Ninjabuilt Technologies for facilitating orders and deliveries.

3. User Responsibilities

As a user of our platform, you agree to:

a) Provide Accurate Information: You must provide truthful, accurate, and complete information when creating an account or placing orders. This includes your name, contact number, email address, and delivery address.

b) Account Security: You are responsible for maintaining the confidentiality of your account credentials. Any activity conducted through your account is your responsibility. Notify us immediately if you suspect unauthorized access.

c) Legal Compliance: You must comply with all applicable local, national, and international laws when using our services. You must be of legal age (18 years or older) to place orders.

d) Appropriate Conduct: You agree not to misuse the platform, harass other users, riders, or restaurant staff, or engage in fraudulent activities.

4. Order Placement and Acceptance

When you place an order through our platform:

a) Order Submission: Your order is submitted to the selected restaurant partner for acceptance. An order is not confirmed until the restaurant accepts it through our system.

b) Restaurant Discretion: Restaurant partners reserve the right to accept or reject orders based on availability, preparation capacity, or delivery area limitations.

c) Order Confirmation: You will receive a notification once your order is confirmed. Estimated preparation and delivery times are provided for reference only and may vary.

d) Order Modifications: Once an order is confirmed by the restaurant, modifications may not be possible. Contact customer support immediately if changes are urgently needed.

5. Payments and Pricing

a) Payment Methods: We accept various payment methods including credit/debit cards, mobile wallets, and cash on deliverySubject to availability in your region. Payment is required at the time of order placement for online transactions.

b) Pricing: All prices displayed on the platform are set by restaurant partners and include applicable taxes unless stated otherwise. Delivery fees and service charges are clearly displayed before order confirmation.

c) Price Changes: Restaurant partners may update prices without prior notice. The price displayed at the time of order placement will be honored for that transaction.

d) Promotional Offers: Discounts, coupons, and promotional codes are subject to specific terms and conditions. Ninjabuilt Technologies reserves the right to modify or cancel promotional offers at any time.

e) Payment Processing: Online payments are processed through secure third-party payment gateways. Ninjabuilt Technologies does not store complete payment card information.

6. Delivery Terms

a) Delivery Service: Deliveries are performed by independent riders who use our platform to accept and fulfill delivery requests. Ninjabuilt Technologies acts as an intermediary connecting customers with riders.

b) Estimated Delivery Time: Delivery time estimates are approximate and depend on factors including restaurant preparation time, traffic conditions, weather, and rider availability. We strive for timely deliveries but cannot guarantee exact delivery times.

c) Delivery Instructions: Please provide clear and accurate delivery instructions. Additional charges may apply for deliveries to locations outside standard service areas.

d) Failed Deliveries: If a delivery cannot be completed due to incorrect address information, unavailability of the customer, or unsafe delivery conditions, the order may be canceled without refund.

e) Food Safety: While riders are instructed to handle food safely, Ninjabuilt Technologies is not responsible for food quality issues arising from restaurant preparation or delays beyond our control.

7. Cancellations and Refunds

a) Customer Cancellation: You may cancel an order before it is accepted by the restaurant without charge. Once accepted and preparation has begun, cancellations may not be possible, or cancellation fees may apply.

b) Restaurant Cancellation: If a restaurant cancels your order after acceptance, you will receive a full refund of the order amount.

c) Refund Policy: Refunds are processed within 5-10 business days depending on your payment method and financial institution. Service fees and delivery charges may be non-refundable in certain circumstances.

d) Complaints and Issues: If you experience issues with your order (wrong items, missing items, quality issues), please contact customer support within 24 hours of delivery. We will investigate and provide appropriate resolution including refunds or credits where warranted.

8. Use of Platform

You agree to use our platform only for lawful purposes. Prohibited activities include but are not limited to:

• Attempting to gain unauthorized access to our systems or other user accounts

• Uploading malicious code, viruses, or harmful content

• Using automated systems or bots to access the platform

• Engaging in fraudulent transactions or payment disputes

• Impersonating other users, restaurants, or riders

• Harassing, threatening, or abusing platform users or staff

• Scraping or copying content without authorization

• Violating intellectual property rights

Violation of these terms may result in immediate account suspension or termination and possible legal action.

9. Intellectual Property Rights

All content on the Quetta Cafe platform, including but not limited to logos, brand names, text, graphics, software, photographs, and user interface design, is the intellectual property of Ninjabuilt Technologies or its licensors and is protected by copyright, trademark, and other intellectual property lawsLegal protections for creative works.

You may not reproduce, distribute, modify, or create derivative works from any content on our platform without explicit written permission from Ninjabuilt Technologies. The Quetta Cafe brand, logo, and all associated intellectual property rights are owned and maintained by Ninjabuilt Technologies. Restaurant logos and menu content are the property of respective restaurant partners and are displayed with their permission.

10. Privacy and Data Protection

Your privacy is important to us. We collect, use, and protect your personal information in accordance with our Privacy Policy, which forms an integral part of these Terms and Conditions.

By using our platform, you consent to the collection and use of your information including:

• Personal identification information (name, email, phone number)

• Delivery addresses and location data

• Order history and preferences

• Payment information (processed securely through third parties)

• Device information and usage analytics

We implement industry-standard security measures to protect your data and do not sell your information to third parties.

11. Third-Party Links and Services

Our platform may contain links to third-party websites, services, or payment processors. These third parties have their own terms and conditions and privacy policies. Ninjabuilt Technologies is not responsible for the content, accuracy, or practices of third-party sites.

We recommend reviewing the terms and privacy policies of any third-party services you access through our platform. Your interactions with third parties are solely between you and that party.

12. Limitation of Liability

To the maximum extent permitted by law:

a) Ninjabuilt Technologies acts as an intermediary platform connecting customers, restaurants, and riders. We are not responsible for the quality, safety, or preparation of food items provided by restaurant partners.

b) We are not liable for any delays, failures, or issues arising from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, technical failures, or government restrictions.

c) Our total liability for any claims arising from your use of the platform shall not exceed the amount you paid for the specific transaction giving rise to the claim.

d) We are not liable for any indirect, incidental, consequential, or punitive damages including loss of profits, data, or goodwill.

e) While we strive to ensure platform availability, we do not guarantee uninterrupted or error-free service and are not liable for temporary unavailability.

13. Indemnification Clause

You agree to indemnify, defend, and hold harmless Ninjabuilt Technologies, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms and Conditions

• Your misuse of the platform or services

• Your violation of any third-party rights

• Any fraudulent or illegal activity conducted through your account

• Your interactions with restaurant partners or riders

14. Termination of Account

a) User Termination: You may terminate your account at any time by contacting customer support or using the account deletion feature in the app. Upon termination, your personal data will be handled according to our Privacy Policy.

b) Company Termination: Ninjabuilt Technologies reserves the right to suspend or terminate your account immediately without prior notice if you violate these terms, engage in fraudulent activity, or misuse the platform.

c) Effect of Termination: Upon account termination, you will lose access to your order history, saved addresses, and any unused promotional credits. Outstanding payments or liabilities remain valid after termination.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Islamic Republic of PakistanCountry of incorporation.

Any disputes, controversies, or claims arising out of or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Islamabad, Pakistan.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation or mediation.

16. Changes to Terms

Ninjabuilt Technologies reserves the right to modify, update, or replace these Terms and Conditions at any time. Changes will be effective immediately upon posting to the platform with an updated revision date.

Significant changes will be communicated through email notification or in-app announcements. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.
